Amtrak Collision with 18 Wheeler Kills Truck Driver

The driver of an 18-wheeler died on January 14th after being hit by an Amtrak train that was headed to Chicago from San Antonio.

The semi-truck allegedly was blocking part of the train tracks near Mesquite, and the collision immediately caused the truck to burst into flames. Two cars of the Amtrak train also caught fire, but were quickly put out by Amtrak employees.

Once on the scene, firefighters and medical responders continued to put out the fires, evacuate the train cars, and tend to Amtrak passengers. None of the train’s 44 passengers were injured, though one passenger was tended to by medical officials. The accident delayed the train’s route by 5 ½ hours.

Law enforcement is not sure what caused the accident and it is still under investigation.

Those involved in the train accident may have a reasonable case on their hands if they sustained any type of injury and if the cause of the accident is proved to be Amtrak’s fault. However, if the collision turns out to be the truck driver’s fault, the passengers might not have much to claim.

In any case, when a train accident occurs, there are a few steps those involved in the accident should follow:

  1. Report the accident: When the next station is reached, the first thing you should immediately do is file a report, which will provide a written accident report for the inevitable court case.
  2. Take photos: Pictures are usually compelling pieces of evidence in any case. Pictures of your injuries, of the scene, of the train, could go a long way for your claim.
  3. Have your injuries treated: Treating your injuries is vital for your well-being. You may have hidden issues that you’re not aware of. Seeking treatment will also provide proof in your case that you actually sustained injuries in the accident.
  4. Seek a lawyer: The accident case is bound to be both long and complex. Seeking the help of an experienced lawyer will increase your chances of winning. Freeman Law Firm specializes in these types of accidents. Contact us to find out how we can help you.
